Terms of Service

1. Acceptance of Terms
By accessing or using Toast ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
Toast is operated by Toast ("we," "us," or "our") from Vancouver, British Columbia, Canada. We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.
2. Description of Service
Toast is a web-based platform that allows event hosts to create shared photo and video galleries for their events. Guests can upload photos and videos by scanning a QR code — no app download or account required. Hosts can manage, view, download, and export content from their dashboard.
3. Accounts
- Host accounts: You must create an account to host an event on Toast. You are responsible for maintaining the security of your account credentials.
- Event planner accounts: Event planners can create a planner account with business details, purchase credit packs, create events on behalf of clients, and hand off events to hosts via email invitation. Planners may access event metadata and content until the event is claimed by the host.
- Guest access: Guests do not need an account. Guest sessions are authenticated anonymously via Firebase Authentication and are tied to the specific event link.
- You must provide accurate information when creating an account. You are responsible for all activity that occurs under your account.
- Age requirement: You must be at least 16 years old to create a host or planner account on Toast. By creating an account, you represent that you meet this age requirement.
4. Pricing and Payments
Toast offers tiered per-event pricing — each event is a one-time purchase, not a recurring subscription. All prices are in USD and subject to change.
Individual Event Tiers
- Free: Up to 5 guests, 30-day gallery storage. Limited to 1 active free event at a time.
- Starter ($4.99): Up to 15 guests, 12-month storage.
- Standard ($14.99): Up to 50 guests, 12-month storage.
- Plus ($29.99): Up to 100 guests, 12-month storage.
- Premium ($49.99): Up to 200 guests, 12-month storage.
- Unlimited ($69.99): Unlimited guests, 12-month storage.
Event Planner Credit Packs
Event planners can purchase credit packs to create events on behalf of clients:
- Starter Pack ($199): 5 event credits.
- Pro Pack ($499): 15 event credits.
- Agency Pack ($1,249): 50 event credits.
Payments are processed by Polar.sh. All purchases are non-refundable unless otherwise required by applicable law. Guest count limits are enforced — once an event reaches its guest limit, additional guests will not be able to upload.
5. User Content
Ownership
You retain full ownership of all photos, videos, and other content you upload to Toast. We do not claim any intellectual property rights over your content.
License
By uploading content, you grant Toast a limited, non-exclusive, royalty-free license to store, process, compress, display, and transmit your content solely for the purpose of providing the Service. This license ends when you delete your content or your account.
Video Uploads
Video uploads are available on all paid tiers. Videos are subject to the following limits:
- Maximum duration: 3 minutes per video.
- Maximum file size: 200 MB per video.
Responsibility
You agree not to upload content that:
- Violates any law or infringes on the rights of others.
- Contains explicit, violent, harassing, or hateful material.
- Contains malware, viruses, or other harmful code.
- Impersonates another person or misrepresents your identity.
We reserve the right to remove content that violates these Terms without notice.
6. Guest Uploads
Guests who upload photos or videos to an event grant the event host the right to view, download, export, and share that content through the Toast platform. By uploading content as a guest, you acknowledge that:
- The event host can manage and export your content.
- Other guests with the gallery link can view your content.
- The host may delete your content at their discretion.
- Only you or the host can delete your individual uploads.
7. Event Planners
Event planners who create events on behalf of clients acknowledge that:
- Events created using planner credits can be handed off to clients (hosts) via email invitation.
- Once a client claims an event, they become the event host with full control over event settings and content.
- Planner credits are non-transferable and non-refundable unless required by applicable law.
- Planners are responsible for obtaining appropriate consent from clients before creating events on their behalf.
8. Google Drive Export
Toast allows hosts to export event photos and videos to Google Drive. By using this feature:
- You authorize Toast to create folders and upload files to your Google Drive using the
drive.filescope. - Toast can only access files and folders it creates — not your existing Drive content.
- You can revoke access at any time from your Toast dashboard or from your Google Account settings.
9. Data Retention and Deletion
Photos, videos, and event data are retained according to your pricing tier (see Section 4). Free events are stored for 30 days; paid events are stored for 12 months. After the retention period expires, your data is permanently deleted from our servers.
We strongly recommend exporting your content before your retention period ends. You may request early deletion of your account and all associated data by contacting us. We will process deletion requests within 30 days.
10. Prohibited Uses
You may not use Toast to:
- Violate any applicable laws or regulations.
- Distribute spam, malware, or unauthorized advertising.
- Attempt to gain unauthorized access to our systems or other users' accounts.
- Reverse engineer, decompile, or attempt to extract the source code of the Service.
- Use automated tools to scrape, crawl, or extract data from the Service.
- Interfere with or disrupt the integrity or performance of the Service.
11. Service Availability
Toast does not guarantee any specific level of uptime or availability. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We do not offer a Service Level Agreement (SLA).
Because Toast is often used during live events such as weddings, we strongly recommend that hosts and guests also keep local copies of important photos and videos. Toast is not a backup service and should not be relied upon as the sole copy of your content.
12. Disclaimer of Warranties
Toast is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that the Service will be uninterrupted, error-free, or secure. We are not responsible for any loss of photos, videos, or data due to technical failures, network outages, or venue connectivity issues. We strongly recommend exporting your content before your retention period ends.
13. Limitation of Liability
To the maximum extent permitted by law, Toast and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of photos or videos, or loss of revenue, arising from your use of the Service.
Our total liability for any claim related to the Service shall not exceed the amount you paid to Toast in the 12 months preceding the claim.
14. Indemnification
You agree to indemnify and hold harmless Toast and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms.
15. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Sections 5, 12, 13, and 14 survive termination.
16. Dispute Resolution
Before initiating any legal proceedings, you agree to first contact us at support@toastphotos.app and attempt to resolve the dispute informally for at least 30 days. Most concerns can be resolved quickly through direct communication. If the dispute cannot be resolved informally, either party may proceed under the governing law provisions below.
17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts located in Vancouver, British Columbia, Canada.
18. Accessibility
Toast is committed to making our platform accessible to all users. We strive to conform to the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA standards. If you encounter any accessibility barriers while using Toast, please contact us at support@toastphotos.app so we can address the issue.
